Beggs Loyalty Program Terms and Conditions
These Beggs loyalty program terms and conditions govern the rules of participation for buyers in the loyalty program operated by Simply nature s.r.o., with its registered office at Zbraslavská 22/49, Malá Chuchle, 159 00 Prague 5, Czech Republic, ID No.: 10819321, registered in the Commercial Register maintained by the Municipal Court in Prague, section C, file 348990, as the seller and operator of the online store available at the internet address https://www.beggs.cz/ (hereinafter the "online store").
These terms supplement the seller’s general terms and conditions and regulate in more detail the current rules for earning and redeeming loyalty points, loyalty program tiers, and the benefits associated with participating in the loyalty program.
1. Introductory Provisions
1.1. The Beggs loyalty program is a voluntary customer program of the seller, the purpose of which is to support buyers when purchasing goods in the online store and to provide selected benefits to registered customers.
1.2. The loyalty program is operated through the web interface of the online store and is available only to buyers who have established a customer account.
1.3. Loyalty points, rewards, and benefits provided within the loyalty program are not monetary funds, electronic money, investment instruments, or payment instruments, and cannot be exchanged for cash or any other monetary compensation.
1.4. Unless these loyalty program terms state otherwise, the seller’s general terms and conditions shall apply mutatis mutandis to participation in the loyalty program.
2. Participation in the Loyalty Program
2.1. A buyer who has established a customer account in the online store may become a member of the loyalty program. The buyer becomes a member of the loyalty program by registering a customer account, unless stipulated otherwise by the seller.
2.2. Participation in the loyalty program is intended only for buyers acting as consumers, unless stipulated otherwise by the seller in a specific case.
2.3. The buyer is obliged to provide true, correct, and current data during registration and throughout the entire period of participation in the loyalty program. The buyer is responsible for the accuracy of the data provided in the customer account.
2.4. One buyer may have only one customer account and only one participation in the loyalty program. The seller is entitled to cancel duplicate accounts or merge point balances if the technical capabilities of the online store allow it.
3. Earning Loyalty Points
3.1. The buyer earns loyalty points primarily for purchases made through the online store. Unless stipulated otherwise by the seller, the buyer earns 1 loyalty point for every CZK 20 of the purchase price of goods paid by the buyer.
3.2. The amount decisive for the allocation of loyalty points includes the purchase price of the goods actually paid by the buyer after taking into account any discounts. This amount does not include costs for shipping, payment, packaging, gift vouchers, or other similar items, unless stipulated otherwise by the seller in a specific case.
3.3. The seller may also allocate loyalty points to the buyer for other activities defined in the online store, especially for registering a customer account, birthday activity, following the seller’s profile on social networks, leaving a review, or subscribing to the newsletter, if such a method of earning points is currently enabled by the seller.
3.4. Specific methods of earning loyalty points, the number of points allocated for individual activities, the conditions for their allocation, and information on whether a given method of earning points is currently active are listed in the loyalty program within the customer account and/or in these loyalty program terms.
4. Loyalty Program Tiers
4.1. Depending on the number of loyalty points earned, buyers may be assigned to individual tiers of the loyalty program, which may include, in particular, the Silver, Gold, and Beggs Diamond Club tiers.
4.2. The Silver tier is the basic tier of the loyalty program and is generally available from 0 loyalty points.
4.3. The Gold tier is a higher tier of the loyalty program and is generally available upon reaching at least 400 loyalty points.
4.4. The Beggs Diamond Club tier is the highest tier of the loyalty program and is generally available upon reaching at least 700 loyalty points.
4.5. The seller is entitled to change the thresholds for assignment to individual tiers. The assignment of a buyer to a specific tier is governed by the current technical settings of the loyalty program and the status of loyalty points recorded in the buyer’s customer account.
5. Rewards and Benefits
5.1. As part of the loyalty program, the seller may provide buyers with one-off rewards and permanent benefits. One-off rewards are generally provided upon reaching the relevant loyalty program tier or upon meeting conditions determined by the seller. Permanent benefits may be available to the buyer for as long as they are assigned to the relevant loyalty program tier.
5.2. The Silver tier represents the basic tier of the loyalty program. Generally, no permanent benefit is associated with this tier. In this tier, one-off rewards may be available to the buyer, such as a discount on selected products or collections, free shipping in exchange for loyalty points, or other one-off rewards, always according to the seller’s current offer.
5.3. In the Gold tier, the primary benefit may be free shipping to the extent determined by the seller, indicatively up to 2 times per month. The one-off rewards listed for the Silver tier may also remain available to a buyer assigned to this tier, or potentially one-off rewards that are more attractive or advantageous compared to the Silver tier. The seller may also establish a permanent benefit for this tier, in particular a discount on selected products or collections.
5.4. The Beggs Diamond Club tier represents the highest tier of the loyalty program. The primary benefit of this tier may be free shipping to the extent determined by the seller, indicatively up to 4 times per month. All benefits listed for lower tiers may be available to a buyer assigned to this tier, generally to a greater or more advantageous extent, both in the form of one-off rewards and permanent benefits. The seller may also establish for this tier the option to receive a free gift, a product discount, or a one-off discount on a selected product or collection.
5.5. Specific rewards and benefits may be limited in time, quantity, value, to selected goods, collections, orders, shipping methods, or other conditions stated in the online store or in these loyalty program terms. The seller is not obliged to provide all rewards and benefits simultaneously and is entitled to continuously change, supplement, replace, limit, or cancel them.
6. Redeeming Loyalty Points and Benefits
6.1. Loyalty points and benefits can only be redeemed in the manner enabled in the online store, primarily through the customer account or the relevant loyalty program interface.
6.2. Loyalty points cannot be redeemed retroactively for already completed orders, unless expressly permitted otherwise by the seller.
6.3. Neither loyalty points nor benefits are transferable to another person; they cannot be assigned, sold, gifted, or otherwise transferred outside the buyer’s customer account.
6.4. Discounts, rewards, and benefits provided within the loyalty program cannot be combined with each other or with other discounts or promotions, unless expressly stipulated otherwise by the seller.
6.5. Redeeming loyalty points or a benefit may be subject to a minimum order value, availability of goods, a specific shipping method, or other conditions stated by the seller.
7. Validity of Points, Returns of Goods, and Deduction of Points
7.1. Unused loyalty points expire 6 months after they are credited to the buyer’s loyalty program, unless the seller stipulates a longer validity period.
7.2. If a buyer withdraws from a purchase contract, returns purchased goods, cancels an order, fails to pay the purchase price, or if an order is canceled for any reason, the seller is entitled to deduct the loyalty points earned in connection with such an order and adjust the loyalty point balance as if the purchase had not occurred.
7.3. In the event of a partial return of goods or partial cancellation of an order, the seller is entitled to deduct a corresponding portion of the loyalty points.
7.4. If a buyer has redeemed loyalty points, a reward, or a benefit for an order that was subsequently canceled, returned, or not paid for, the seller is entitled to decide on re-crediting the redeemed points or on the expiration of the relevant reward or benefit according to the nature of the specific situation and the technical capabilities of the loyalty program.
8. Buyer’s Obligations and Program Misuse
8.1. The buyer is obliged to use the loyalty program in good faith, in accordance with these terms, the seller’s general terms and conditions, good morals, and the purpose of the loyalty program.
8.2. The buyer must not misuse the loyalty program, in particular by creating duplicate accounts, placing fictitious orders, purposefully returning goods, unauthorized earning of points, or circumventing the technical rules of the program.
8.3. In the event of a breach of these terms, the seller is entitled to revoke the buyer’s loyalty points, cancel a provided reward or benefit, restrict the ability to draw benefits, or exclude the buyer from the loyalty program.
8.4. In the event of a serious or repeated breach of the loyalty program terms, the seller is entitled to cancel the buyer’s participation in the loyalty program; this does not affect the seller’s right to revoke loyalty points, rewards, or benefits obtained in violation of these terms.
9. Exclusions from the Loyalty Program
9.1. Loyalty points, discounts, rewards, and benefits provided within the loyalty program do not apply to goods for which this is excluded by legal regulations, in particular infant formula and foods for special medical purposes.
9.2. The seller is entitled to unilaterally exclude other goods, collections, brands, orders, promotions, or other groups of cases from the loyalty program, in particular by making it impossible to earn loyalty points, redeem loyalty points, discounts, rewards, or other benefits for them. The seller will state such an exclusion in the online store, in these loyalty program terms, or in the terms of a specific benefit.
10. Changes and Termination of the Loyalty Program
10.1. The seller is entitled to change, supplement, limit, or cancel these loyalty program terms, the rules for earning and redeeming points, the thresholds for individual tiers, rewards, benefits, and the technical settings of the loyalty program at any time. A change in the terms does not affect the buyer’s rights acquired before the change takes effect, in particular, already duly redeemed rewards or benefits, unless the nature of the specific reward, benefit, or technical settings of the loyalty program clearly indicates otherwise.
10.2. The seller is entitled to suspend or terminate the loyalty program at any time, even without prior notice to the buyer. In the event of the termination of the loyalty program, the seller may establish a transitional period for redeeming unused loyalty points. Unless stipulated otherwise by the seller, unused loyalty points expire on the day of the termination of the loyalty program.
10.3. The current wording of these loyalty program terms is always decisive for participation in the loyalty program from the date of its publication in the online store, unless a later effective date is stipulated by the seller.
10.4. The seller recommends that the buyer regularly monitor the current wording of these loyalty program terms and the information provided in the loyalty program, especially within the customer account.
